The Marvin Windows New Spin Sweepstakes (“Sweepstakes”) is open only to individuals who are licensed/registered professional builders or remodelers. Entrants must be legal residents of the 50 US/DC and be 18 years of age or older (19 or older for AL/NE residents) at the time of entry. Employees or agents of Marvin Windows and Doors (“Sponsor”) and its parent, subsidiaries, affiliates, officers, directors, employees, advertising and promotional agencies, prize providers and their immediate family members (parent, child, sibling and spouse) and/or those individuals residing in their same household are not eligible to enter or win. Void where prohibited by law. This Sweepstakes is not open to the general public. All federal, state and local laws and regulations apply.
2. AGREEMENT TO OFFICIAL RULES:
By participating in this Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes.
3. HOW TO ENTER:
Beginning at 12:00:00 AM Central Time (CT) on 6/01/15 through 11:59:59 PM (CT) on 8/31/15 log on to http://www.marvin.com/marvin/promotions/double-hung
and follow the on-screen instructions to complete and submit the on-line entry form. Limit one (1) entry per person. Multiple entrants are not permitted to share the same email address. Any attempt by a participant to exceed or manipulate the entry specifications and/or limitations, including by using multiple/different email addresses or any other methods, will void that entrant’s entries and that entrant may be disqualified. Use of script, macro or any other automated system to enter the Sweepstakes is prohibited and all such entries will be void.
4. RANDOM DRAWING/ODDS OF WINNING/WINNER NOTIFICATION:
Ten (10) potential prize winners will be selected in a random drawing held on or about 9/01/15 from among all eligible entries received. Odds of winning depend upon the number of eligible entries received. Potential winners will be contacted by email and/or phone and must respond within 48 hours from the time on notification. If potential winner does not respond within 48 hours from notification, and/or the notification is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected, time permitting. Once potential winner responds within 48 hours, he/she will be required to sign and return an Affidavit of Eligibility/Release of Liability/Publicity Release Form within three (3) days of receipt of these documents. (Prepaid overnight courier/mail service will be provided with Affidavit). Noncompliance may result in prize forfeiture and an alternate may be selected, time permitting.
5. PRIZES & APPROXIMATE RETAIL VALUE (“ARV”):
Ten (10) Prizes – a trip for winner to attend The Who concert on October 10, 2015 in Minneapolis, Minnesota and a VIP Tour of Marvin Windows and Doors Headquarters in Warroad, MN. Prize consists of round trip coach class airfare from a major airport near winner’s residence to Minneapolis, MN; 4 days/3 nights hotel accommodations (one room, single occupancy) at Sponsor-specified hotel; one (1) VIP concert ticket (main floor seating) to The Who concert (including pre-show meal and beverages), a day trip via private aircraft to the Marvin Windows and Doors Headquarters and round trip ground transportation in Minnesota (airports/hotel/headquarters). Trip dates October 8-11, 2015. Winner must take trip on dates specified or will forfeit the prize in its entirety. ARV: $1,575 each prize. Actual retail value may vary depending on winner’s point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value will not be awarded. If winner resides within 250 miles of Minneapolis, he/she will receive a travel stipend in the amount of $250 in lieu of commercial airfare and ground transportation. All other travel-related expenses, including but not limited to ground transportation not specified, luggage fees, meals, gratuities and incidental hotel and personal expenses are the sole responsibility of the winner. Selection of airport, airline, flight itinerary and hotel are solely within Sponsor’s discretion. Sponsor is not responsible if any event is postponed or cancelled after ticketing of prize for any reason, in whole or in part. In that event, winner will receive remainder of the prize. No compensation will be paid in lieu of the ticket portion of prize. Tickets are not redeemable or exchangeable for cash and are subject to all terms and conditions of use as established by issuer. Once trip is booked, any changes made at winner’s request are at winner’s expense. Winner must possess required travel documents (e.g. valid Photo ID) prior to departure. Prizes consist of only the items specifically listed as the prize. Sponsor reserves the right to substitute prize (or any portion of prize) for one of equal or greater value. No substitution, cash redemption or transfer of prize by winner permitted. All federal, state and local taxes are the sole responsibility of winner. Winner will be issued an IRS Form-1099 for tax purposes for the retail value of the prize and winner is advised to seek independent counsel on the implications of his/her winnings.
6. RELEASE AND LIMITATIONS OF LIABILITY/GENERAL RULES:
By entering Sweepstakes entrants agree to release and hold harmless, Marvin Windows and Doors and its parent, subsidiaries, affiliates, officers, directors, employees, advertising and promotional agencies, and prize providers (the “Released Parties”) from and against any claim or cause of action arising out of participation or attempt to participate in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; incorrect announcements of any kind (d) errors in the administration of the Sweepstakes or the processing of entries; lost, late, damaged, delayed, incomplete, unintelligible or misdirected entries, entries not received by the entry deadline; (e) injury or damage to persons or property which may be caused directly or indirectly, in whole or in part from entrant’s participation in the Sweepstakes or receipt, use, inability to use or misuse of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes and in no event shall the Released Parties be liable for incidental or consequential damages or attorney’s fees. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION S IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or e-mail client or insufficient space in user’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by the Sponsor, in their sole discretion. In the event of termination, a notice will be posted online and the random drawing will be conducted from among all eligible entries received prior to the time of termination. No more than the stated number of prizes will be awarded. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Sweepstakes entry, if it is possible. In the event a dispute arises regarding specific individual entitled to receive prize, entry will be declared made by the “authorized e-mail account holder”, and any damage made to the Web site will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrant may be requested to provide Sponsor with proof that the entrant is the authorized e-mail account holder of the e-mail address associated with the account/submission. Proof of submitting entries will not be deemed to be proof of receipt by the Sponsor. All materials submitted become the property of Sponsor and will not be returned. Acceptance of prize constitutes permission to the Sponsor to use winners’ names, photograph, video and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law.

By participating in this Sweepstakes, you acknowledge and agree that all information and material, including any personal information provided in your entry materials, affidavits, and releases, will be collected, used and disclosed by Sponsor and its authorized agents, representatives, and other third parties involved in the execution, administration, or hosting of this Sweepstakes, for the purposes of administering the Sweepstakes and prize fulfillment and may be further publicized as described above.
8. OPT OUT:
To opt out of receiving notices of future sweepstakes offered by Sponsor, please use the opt-out feature contained in the original email notice, or mail your request to Marvin Windows and Doors, Sweepstakes Administrator, 2020 Silver Bell Rd., Ste. 15, St. Paul, MN 55122.
Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or
connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resorting to any form of class action, and exclusively by the United States District Court for Minneapolis, Minnesota or the appropriate Minnesota State Court; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
